Thank you for visiting this website (the "Website"), operated by Jakon Nete, a New Mexico nonprofit religious corporation ("Jakon Nete," "we," "us," or "our").

These Terms of Use (the "Terms") govern your access to and use of the Website. All references to "you" or "your" refer to the user of the Website.

In addition to these Terms, please review our Privacy Policy, which describes our practices related to the collection, use, storage, and sharing of information. By accessing or using the Website, you represent and agree that you have read, understand, and agree to be bound by these Terms and our Privacy Policy.

PLEASE CAREFULLY READ THESE TERMS, AS THEY CONTAIN IMPORTANT INFORMATION ABOUT YOUR RIGHTS AND RESPONSIBILITIES, INCLUDING LIMITATIONS OF OUR LIABILITY.

Our facilitators and spiritual leaders are not acting as your physicians, psychiatrists, psychologists, therapists, or other licensed healthcare providers. And by providing information through this Website, you are not creating any form of formal relationship between us and you.

If you are considering applying to participate with us, we ask you to speak with your own qualified healthcare provider, particularly regarding any medications, supplements, medical conditions, or mental-health conditions that may be relevant to participation.

You should never consider information on this Website a substitute for advice from your own qualified healthcare provider or a basis for starting, stopping, tapering, or changing any prescription medication or treatment.

Information on this Website, including information concerning preparation, dietary guidance, medications, contraindications, or participant safety, is general in nature and may not reflect every relevant risk, individual circumstance, or the most current medical information.

3. Website Use Does Not Create a Right to Participate

Your access to or use of the Website, submission of an intake or application, registration for an event, scheduling of a meeting or session, correspondence with us, donation to Jakon Nete, or other interaction through the Website does not entitle you to participate in any ceremony, event, session, or other religious practice.

Participation in any ceremony, event, session, other religious practice, or any other activity offered by us is subject to Jakon Nete's separate review and invitation process. We may decline, condition, postpone, or withdraw an invitation to participate at our sole and absolute discretion, including without limitation where we believe doing so is appropriate for participant or community safety.

Actual participation in ceremonies, events, sessions, other religious practices, or other activities offered by us is governed by separate participant agreements, waivers, informed-consent documents, policies, and instructions provided in connection with that participation. These Terms only govern use of the Website.

These Terms do not replace, modify, waive, or limit those separate participation agreements.

4. Prohibited Uses

As a condition of accessing and using the Website, you agree not to use the Website or any content on the Website for any purpose that:

  • Violates any applicable law, rule, or regulation;
  • Infringes the intellectual property or other rights of Jakon Nete or any third party;
  • Constitutes the unauthorized transmission of unsolicited commercial electronic communications or spam;
  • Involves threatening, harassing, defamatory, fraudulent, or deceptive conduct;
  • Violates, attempts to violate, or knowingly facilitates the violation of the security or integrity of the Website or any system connected to it;

You further agree not to provide false or misleading information through intake, health-screening, medication, registration, waiver, or other participant-safety forms. Accurate disclosure is particularly important where incomplete or false information could create a safety risk to you or others.

You may provide us with information about yourself through the Website.

By providing information or other content, you grant us the right to use that information for purposes reasonably related to operating the Website, communicating with you, evaluating or facilitating your relationship with Jakon Nete, conducting our religious and charitable activities, and otherwise as described in our Privacy Policy.

We do not claim ownership over personal information or other content you provide to us.

By submitting information, you represent and warrant that the information is accurate and that you own, or have the legal authority or permission necessary to provide, the information.

If you provide information about another person, for example, by naming an emergency contact or referring someone to us, you represent that you have appropriate permission to provide that information.

The Website should not be relied upon as your own means of storing or preserving information, and we assume no responsibility for maintaining copies for your personal use.

6. Communications From Jakon Nete

Communications necessary to administer something you have requested or undertaken with us, including communications concerning an application, ceremony or event registration, scheduled meeting or session, participant preparation, safety, follow-up, donation, or other transaction, are operational communications and may be sent as necessary to provide those activities or services.

Our Website may be integrated with services provided by third parties as part of its functionality, including services used for donations, scheduling, communications, security, or other Website operations.

We have no control over third parties and make no guarantees about, and assume no responsibility for, information or services provided by third parties.

8. Our Content and Intellectual Property

The Website and the text, images, graphics, design, photographs, videos, and other materials created by Jakon Nete or used by us with permission are the property of Jakon Nete or the applicable rights holder.

Subject to these Terms, we grant you a limited, nonexclusive, nontransferable, and revocable license to access and use this material for its intended personal and non-commercial purposes.

You may read Website pages, share links to them, and print reasonable portions for your personal, non-commercial use.

Except as expressly permitted above, you may not sell, redistribute, republish, reproduce, commercially exploit, or create derivative works from our Website content without our prior written permission.

Some material presented through Jakon Nete relates to Shipibo-Konibo language, knowledge, practices, cultural expressions, and heritage. Jakon Nete does not claim ownership of the cultural heritage of the Shipibo-Konibo people merely because material concerning that heritage appears on our Website. We present such material in the context of our religious practice and relationships and ask visitors to treat it with appropriate respect.

9. Disclaimer of Warranties; "As Is"

THE WEBSITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE."

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JAKON NETE EXPRESSLY DISCLAIMS ANY AND ALL WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE WEBSITE AND ITS CONTENT, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY OF INFORMATION, TIMELINESS OF INFORMATION, SYSTEM INTEGRATION, TITLE, AND NON-INFRINGEMENT.

YOU ASSUME THE RISK OF DAMAGE OR LOSS ARISING FROM YOUR USE OF, OR INABILITY TO USE, THE WEBSITE, TO THE EXTENT PERMITTED BY LAW.

WE DO NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, FREE FROM HARMFUL COMPONENTS, OR THAT INFORMATION ON THE WEBSITE WILL ALWAYS BE COMPLETE, ACCURATE, OR CURRENT.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JAKON NETE AND ITS DIRECTORS, OFFICERS, EMPLOYEES, FACILITATORS, SPIRITUAL LEADERS, VOLUNTEERS, CONTRACTORS, AND AGENTS SHALL NOT BE LIABLE FOR DAMAGES OF ANY KIND, INCLUDING SPECIAL, INDIRECT, INCIDENTAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, LOST PROFITS, LOST DATA, OR LOSS OF USE, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO, USE OF, INABILITY TO USE, OR RELIANCE UPON THE WEBSITE OR ITS CONTENT, REGARDLESS OF THE FORESEEABILITY OF THOSE DAMAGES.

Without limiting the foregoing, and to the maximum extent permitted by law, this limitation applies to damages arising from or related to:

  • Reliance on information provided through the Website;
  • Errors, omissions, or outdated information;
  • Loss, corruption, or unauthorized disclosure of data;

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL THE AGGREGATE LIABILITY OF JAKON NETE AND THE PERSONS LISTED ABOVE ARISING OUT OF OR IN CONNECTION WITH THESE TERMS AND YOUR USE OF THE WEBSITE EXCEED ONE HUNDRED DOLLARS ($100.00).

THE LIMITATIONS OF DAMAGES SET FORTH ABOVE ARE MATERIAL PROVISIONS OF THESE TERMS.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CERTAIN TYPES OF DAMAGES OR CAUSES OF ACTION. TO THE EXTENT SUCH A LIMITATION IS NOT PERMITTED, THE ABOVE LIMITATION WILL APPLY ONLY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.

11. Indemnification

To the maximum extent permitted by law, if a third party brings a claim against Jakon Nete arising out of or related to your misuse of the Website, your information or content, your violation of these Terms, your violation of another person's rights, or your unlawful activity in connection with the Website, you agree to indemnify, defend, and hold harmless Jakon Nete and its directors, officers, employees, facilitators, spiritual leaders, volunteers, contractors, and agents from and against third-party claims, losses, liabilities, damages, judgments, costs, and expenses, including reasonable attorneys' fees and costs, relating to such claim.

We will provide reasonable notice of any such claim and reasonable cooperation, at your expense, in its defense. Failure to provide prompt notice will not relieve you of your indemnification obligations except to the extent that the delay materially prejudices your ability to defend the claim.

Jakon Nete reserves the right, at its own expense, to participate in or assume control of the defense of any matter otherwise subject to indemnification. You may not settle a claim in a manner that imposes liability, obligations, admissions, or restrictions upon Jakon Nete without our prior written consent.

12. Dispute Resolution

If you have a dispute, claim, or controversy with Jakon Nete arising out of or relating to these Terms or your use of the Website, we both agree to resolve the matter in the following manner.

Informal Resolution

First, we will attempt in good faith to resolve the dispute informally.

You may contact us at connect@jakonnete.org. We encourage you to raise concerns directly with us, and we will make a good-faith effort to discuss and resolve them.

Mediation

If the dispute cannot be resolved informally, the parties agree to attempt in good faith to resolve it through mediation before pursuing further remedies.

Unless the parties agree otherwise, mediation will take place in Santa Fe County, New Mexico, before a mutually acceptable mediator. The parties will share the mediator's fees equally unless they agree to a different arrangement.

Arbitration

If the dispute is not resolved through informal resolution and mediation, we both agree to participate in binding arbitration administered by JAMS, which shall take place in Santa Fe County, New Mexico.

We both agree that, in the event of arbitration, or in the event of a lawsuit as permitted by this Section or otherwise, the prevailing party shall be entitled to costs and fees (including reasonable attorneys' fees). Arbitration pursuant to this Section shall be confidential, and neither you, nor Jakon Nete, nor the arbitrator may disclose the existence, content or results of any arbitration, except as may be required by law or for purposes of enforcement or appeal of the arbitration award. Judgment on any arbitration award may be entered in any court having proper jurisdiction. There shall be no right or authority for any claims subject to this arbitration clause to be arbitrated on a class action or consolidated basis or on bases involving claims brought in a purported representative capacity on behalf of the general public (including, but not limited to, as a private attorney general). If any portion of this arbitration clause is determined by a court to be inapplicable or invalid, then the remainder shall still be given full force and effect.

YOU AND JAKON NETE EACH HEREBY IRREVOCABLY WAIVE ANY AND ALL RIGHT TO TRIAL BY JURY IN ANY LEGAL PROCEEDING ARISING OUT OF OR RELATED TO THIS AGREEMENT OR THE TRANSACTIONS CONTEMPLATED HEREBY.

Injunctive Relief

Nothing in this Section prevents either party from seeking temporary, preliminary, or other injunctive relief where reasonably necessary to prevent immediate or irreparable harm.

13. Governing Law, Venue, and Personal Jurisdiction

These Terms shall be governed by the laws of the State of New Mexico, without regard to conflict-of-law principles.

To the extent a judicial proceeding may be brought as permitted under the terms above arising out of or relating to these Terms or use of the Website, you and Jakon Nete agree that the proceeding will be brought in an appropriate state court located in Santa Fe County, New Mexico, or, where federal jurisdiction exists, in the appropriate federal court serving Santa Fe County, New Mexico.

You and Jakon Nete consent to venue and personal jurisdiction in those courts to the extent permitted by law.

14. Severability and Waiver

If, for any reason, any provision of these Terms is found invalid, illegal, or unenforceable, the remaining provisions will remain unaffected and in full force and effect to the maximum extent permitted by law.

Our failure to enforce any provision of these Terms on one occasion does not constitute a waiver of our right to enforce that provision or any other provision later.

No waiver by Jakon Nete shall be effective unless made in writing by an authorized representative of Jakon Nete.

15. Changes to These Terms

Jakon Nete may revise these Terms from time to time, with or without notice to you.

The current version will be posted on this Website with its applicable Effective Date.

If you continue to use the Website after revised Terms become effective, your continued use constitutes acceptance of the revised Terms to the extent permitted by applicable law.
